1. Account Registration

1.1. In order to use our platform, you must register for an account in our portal.

1.2. During your registration, you agree to provide accurate, current, and complete information as required.

1.3. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2. Use of the Platform

2.1. Our platform is intended for use by duly registered and licensed therapy practitioners and their authorized staff members for the purpose of managing therapy practices.

2.2. You agree not to use our platform for any unlawful or unauthorized purpose, including but not limited to violating any applicable laws or regulations.

3. Client Data and Confidentiality

3.1. You understand and agree that you are solely responsible for the confidentiality, security, and legality of any client data or other information that you upload, store, or transmit through our platform.

3.2. We will maintain appropriate technical and organizational measures to protect the security and confidentiality of client data, in accordance with industry standards and applicable laws.

4. Payment and Billing

4.1. If you choose to subscribe to our platform or purchase any additional features or services, you agree to pay all fees associated with your subscription or purchase in accordance with our pricing and billing terms.

4.2. Refunds may be provided on a case-by-case basis. Please contact our support team within 48 hours and provide details regarding your payments and the reason why you need a refund. Refunds will be processed within 7-14 working days from the date of approval of the refund request.

5. Intellectual Property

5.1. Our platform and its content, including but not limited to software, text, graphics, logos, and images, are the property of WASHAURI TECH SERVICES and are protected by copyright, trademark, and other intellectual property laws.

5.2. You are granted a limited, non-exclusive, non-transferable license to use our platform for its intended purpose, subject to these terms.

6. Limitation of Liability

6.1. To the fullest extent permitted by law, WASHAURI TECH SERVICES shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunity, arising out of or in connection with your use of our platform.

7. Termination

7.1. We reserve the right to suspend or terminate your access to our platform at any time, for any reason, without prior notice or liability.

7.2. Upon termination, all provisions of these terms which by their nature should survive termination shall survive, including but not limited to provisions regarding intellectual property, confidentiality, and limitation of liability.

8. Changes to Terms

8.1. We may revise these terms of service at any time without prior notice. By continuing to access or use our platform after any revisions become effective, you agree to be bound by the updated terms.

9. Governing Laws

9.1. These terms of service shall be governed by and construed in accordance with the laws of Kenya, including but not limited to the Data Protection Act-2019, the counselors and psychologist Act-2014 among others without regard to its conflict of laws principles.
